SB 323 adds new Civil Code section 5105(b), which provides that “[a]n association shall disqualify a person from a nomination as a candidate for not being a member of the association at the time of the nomination.”
SB 323 adds new Civil Code section 5105(h), which provides that “[e]lection operating rules adopted pursuant to this section shall not be amended less than 90 days prior to an election.”
SB 323 adds new Civil Code section 5105(g)(4), which provide that “[n]otwithstanding any other law" election rules shall "[r]equire the inspector or inspectors of elections to deliver, or cause to be delivered, at least 30 days before an election, to each member" the ballot and a copy of the election rules.
SB 3232 adds new Civil Code section 5105(g), which provides that “[n]otwithstanding any other law,” election rules shall “[r]equire the ballot of a person with general power of attorney for a member to be counted if returned in a timely manner.”
SB 323 adds new Civil Code section 5105(g)(1), which provides that “[n]otwithstanding any other law,” election rules shall “[p]rohibit the denial of a ballot to a member for any reason other than not being a member at the time when ballots are distributed.”
